RNCC doubles down on false claim that Rep. Tom Malinowski lobbied against sex offense registry


What is the RNCC? "The National Republican Congressional Committee (NRCC) is a political committee devoted to increasing the number of Republicans in the U.S. House of Representatives."

As piss poor as Dems have been on criminal justice reform, remember that Repubs are just that much worse. 

The short version is Rep. Malinowski once worked with the Human Rights Watch. The HRW wrote a report critical of the controversial Adam Walsh Act, though Malinowski had no part in that effort. So the RNCC is trying to link him to the report in hopes to scare the public. To that end, they made this horrible, Shiitake-worthy video:

This is an eerie ad that starts off with the chilling words: “In every city, in every neighborhood, around every corner, sex offenders are living among us.” It has dark images and subtitles that claim “Tom Malinowski, helping sexual predators hide in the shadows” and “Tom Malinowski chose sex offenders over your family.”

Malinowski (D-N.J.) is a first-term member of Congress. He won a seat previously held by a Republican and so is high on the list for Republicans to win back the House. The Cook Political Report currently rates the race “lean Democrat.”

But this ad is not attacking Malinowski for anything he may have done in Congress; it makes these charges based on his tenure as an official at Human Rights Watch, a leading nongovernmental organization that exposes human rights abuses around the world.

In his first race, Malinowski was falsely attacked for supposedly lobbying for terrorist rights. (He argued that Guantánamo detainees had a right to a hearing to challenge the basis for their detention — a position later held up by the Supreme Court.)

Somehow, this detail in his past must have escaped GOP researchers in 2018. Let’s take a look.

Disclosure: The writer of this fact check was The Washington Post’s chief State Department correspondent for nine years, 2002 to 2011, and quoted Malinowski 18 times during that period on various human rights issues. During that period, he once met Malinowski for a few minutes in the green room at “PBS NewsHour.”

The Facts

Malinowski is a longtime foreign policy maven. Before joining HRW, he worked at the State Department and the White House National Security Council. During Barack Obama’s second term, Malinowski was named assistant secretary of state for human rights. Interestingly, his registering as a lobbyist — on behalf of the victims of genocide in Darfur and Myanmar, among other issues — prevented his appointment in Obama’s first term because of rules adopted by the new president.

So it was surprising to see the claim that Malinowski was involved in a domestic issue such as the national sex offender registry.

Michael McAdam, NRCC national press secretary, said the ad is based on solid facts: “His name is on the lobbying disclosure lobbying against the sex offender registry.” Moreover, he said, Malinowski’s title was Washington advocacy director, indicating he headed the organization’s Washington activities.

Pages 2 and 3 of the 2006 lobbying form list dozens of issues, including “sex offender legislation.” Malinowski is listed, but so is Jennifer Daskal.

Daskal, a professor at American University, said in an interview that she was the HRW lobbyist for U.S. domestic issues while Malinowski handled the foreign policy side. “I was not working Darfur,” she said. “He was not working these issues,” referring to the sex offender registry.

In media interviews at the time, Daskal was identified as U.S. program advocacy director for HRW.

Daskal contributed $500 to Malinowski’s House campaign in 2017, a fact that McAdam cited to rebut her as a credible witness. But Daskal noted that in the Congressional Record, a letter on behalf of HRW was published under her name and title (“Advocacy Director, U.S. Program”), raising concerns about the legislation. McAdam did not respond to queries about the letter.

Emma Daly, an HRW spokeswoman, also confirmed that Malinowski was not involved in legislation. “HRW’s job titles can be a bit confusing, but the Washington director role covers foreign policy,” Daly said. “Jen Daskal worked for the U.S. program, which focuses on U.S. domestic issues.”

Both Daly and Daskal objected to the way the ad framed HRW’s concerns about the legislation. “HRW advocated for laws that better protect children and the public by reforming sex offense registries and focusing law enforcement resources to tackle those most at risk of offending,” Daly said. “The ad wrongly portrays this position as helping ‘predators hide in the shadows’ and otherwise being in favor of sex offenses. That’s false.”

The ad claims HRW was “strongly opposed” to a national sex offender registry. But the letter signed by Daskal did not object to creating one.

Instead, the letter said HRW opposed the bill because the language was so sweeping that it included low-level or misdemeanor offenders, such as people charged with public urination, who were attempting to reintegrate into the community after serving their sentences. “Registration requirements put these individuals at risk of retaliation and discrimination and make it extremely difficult for these individuals to find employment, housing, and to rebuild their lives,” Daskal wrote.

Daskal said it was originally Malinowski’s idea to submit lobbying forms, a fact confirmed by a Malinowski aide. He said Malinowski read about new lobbying requirements and decided to submit a lobbying disclosure form out of an abundance of caution.

“They opted not to hire a consulting firm to help with the process. This led them to fill out the forms by listing every lobbying activity undertaken by the organization and signing all lobbyists to the form,” the aide said. “Eventually, they did hire an out-of-house specialist who informed HRW they were not legally obligated to submit these lobbying forms and so they stopped.”

Ironically, that decision led to a delay in Malinowski’s appointment to the Obama administration and now at least two attack ads.

(Note: The ad describes HRW as a “radical” organization. That may be a matter of opinion — in 2019 Israel expelled the HRW director for Israel and Palestinians — but the group won the Nobel Peace Prize in 1997 for its work fighting land mines. The group has been criticized by two other Nobel laureates for having “close ties” and a “revolving door” with the U.S. government, such as Malinowski’s appointment in the Obama administration.)

The Pinocchio Test

This ad makes some bold claims that put Malinowski at the center of the action: “Tom Malinowski tried to make it easier for predators to hide in the shadows. … Law enforcement praised the national sex offender registry that Tom Malinowski led an effort to stop. … Tom Malinowski chose sex offenders over your family.”

The supposed evidence is a lobbying disclosure form that lists Malinowski and Daskal as handling dozens of issues, not identifying who was the point person on any of them. But Daskal said she was in charge of domestic issues — a claim backed by her signature on the letter to lawmakers on the issue. Malinowski had the title of Washington advocacy director, but HRW says that means he did foreign policy — which makes sense, given HRW is primarily a foreign policy organization.

Moreover, HRW did not oppose a national sex offender registry as the ad implies.

The bulk of the evidence shows Malinowski played no role in this debate. But he did work for an organization that objected to a type of national sex offender registry created in legislation. That fact might have kept this ad at Three Pinocchios. But the NRCC’s over-the-top language — such as “Tom Malinowski chose sex offenders over your family” — tipped our rating to Four. Such inflammatory claims should not be made on such flimsy evidence.

BLM/ Cancel Culture activists bash Sheriff's Office for accepting "All Lives Matter" cake from Black Registrant


BLM and Cancel Culture find the phrase "All Lives Matter" offensive because not all lives matter to these activists. They certainly don't care about black lives when that black life says All Lives Matter, as is the case in this story.

To summarize the story, black man gives cops an All Lives Matter cake, pic was posted on social media, BLM/ Cancel Culture activists were triggered and dug up dirt on the black man, discovered he's a Registered Person, and went on the attack.

So, black lives only matter if they blindly support BLM? All of a sudden, a black man's records are taken into account? Records don't count when BLM is protesting for George Floyd. The hypocrisy of BLM and "Cancel Culture" is why I don't support them despite being liberal.

Bedford County Sheriff’s Office responds to post of registered sex offender presenting “All Lives Matter” cake

The Bedford County Sheriff’s Office today responded to discussion concerning an image posted on its Facebook page last week of a registered sex offender holding a cake that appears to say “All Lives Matter.”

The original post is dated July 14 and shows Chris Pannell of Bedford giving the cake to the sheriff’s office. According to the Virginia Sex Offender Registry, Parnell’s date of conviction was Jan. 4, 2008, in Bedford Circuit Court under the aggravated sexual battery statute.

The original post reads (in italic):

Sheriff Miller and the men and women of the BCSO would like to thank The Patterson Family for the food donation yesterday that fed the employees. The barbecue, slaw, and brownies were delicious.  We also appreciated the prayer that was give to us by this family.

Additionally, Chris Parnell came by yesterday with a cake showing his support for law enforcement.  Who doesn't love a good cake??

We understand that there is a vast majority of citizens in Bedford that support and appreciate the hard work done by the dedicated men and women of the Sheriff’s Office.  Thank you for your outpouring of support, we enjoy hearing positive comments from our community.

As of Tuesday night, the original post received hundred of likes and more than a hundred comments, mostly positive.

However, there were several comments visible that called out the sheriff’s office with remarks such as “So the people who swore to serve and protect have a registered sex offender holding an ‘All Lives Matter’ cake,” and, “This seems like the police are purposely doing this to rile up the community. Why would they post something like this during such a heated time in a long awaited, continued movement?”

In response to multiple comments about the photo, the sheriff’s office posted the following response today (in italic):

There has been much discussion on our Facebook page about a post from last week.  The photo shows a member of our community donating a cake to the Sheriff’s Office.  Although many appreciated this citizen's actions, others questioned his motives and bring up his past.

The Sheriff’s Office appreciates all our citizens. We further believe that even those with a prior criminal history should have the opportunity to turn their life around and fix the errors of their ways after their debt to society is paid.

The photo from last week reflects our relationship with the citizens of Bedford County, a relationship of mutual respect.  We respect our citizens and understand that, just as individuals can make mistakes, they can also become contributing members of society.  We appreciate the friendly gesture by Mr. Pannell and his attempt to build bridges during this difficult time for many members of our nation.  The posting of this photo was meant as nothing more as a word of thanks for that effort.  We apologize to anyone that may have misconstrued Mr. Pannell's actions or the actions of BCSO by posting it.

This isn’t the first time that a local sheriff’s office posted an “All Lives Matter” message that received backlash. The phrase is often used as a response to “Black Lives Matter,” in which opponents say the “All Lives Matter” phrase ignores the issues that the black community are facing.

A sheriff’s office in the area recently posted an image of a black person’s hand and white person’s hand crossed with pinkies locked and the words “All Lives Matter” below.

The sheriff’s office posted a follow-up post after receiving backlash in comments and explained that a volunteer had posted the image over a weekend and will have additional training about posting sensitive subjects.

The Smith Mountain Eagle had seen this post but cannot verify if it came from the Bedford County Sheriff’s Office’s Facebook page as it is not visible on the page.








This loser falsely accused me of being convicted multiple times for multiple sex offenses, and could not
back up his claims with evidence. Apparently, he thought because there are two Derek Logues on the registry,
that means multiple offenses. What a dumbass!

No Kid Hungry rejects $200,000 donation from rapper Tekashi 6ix9ine because his sex offense conviction is against their "principals"

Like most every other human being on the planet, people convicted of sex offenses donate to charities. While I have seen other stories where charities have rejected donations from Registered Persons, this is bigger not just because of the size of the donation, but the fame of the person donating, as well as the fact he was convicted of a sex offense. I'm not one to share info about a conviction, but in this instance, it is worth noting that Tekashi 6ix9ine was convicted of a (relatively petty) sex offense but as part of a plea got probation and avoided registration status. However, being a celebrity means this was reported everywhere and brought up as the reason the charity rejected the donation.

I can think of better places Tekashi 6ix9ine can donate his money, like OnceFallen.com for example. After all, we help those everyone with a sex offense conviction navigate this complex registry no matter what their background it, and 100% of donations go to the cause itself, not to paying board members between $150k and $400k annually, as No Kid Hungry apparently does.

Now I want to know if No Kid Hungry also denies services to children if they are children of registered persons.

After Tekashi 6ix9ine ******  in his "Gooba" comeback single and video and flashed stacks of cash and a $1 million diamond-encrusted pendant, the 24-year-old rapper felt like doing some good.

He reportedly made $2 million in less than a week since the May 8 release date of "Gooba" and its accompanying merchandise line, according to TMZ. So what's the first thing 6ix9ine tried doing with a cool $2 mil? Donate 10% of the profit, which comes out to $200,000, to No Kid Hungry, a national campaign that primarily strives to end child hunger -- especially during coronavirus when one in four kids could struggle with food insecurity after schools shut down and unemployment rates spiked, according to the website's opening statistic.

"During this pandemic I understand we have nurses and frontline Hero’s who risk there life daily to save others. But NEVER forget the children & families who depend on OUR PUBLIC schools for daily meals and nutritions to keep our future leaders growing to their best potential," 6ix9ine (real name Daniel Hernandez) wrote in a since-deleted Instagram post. "To every influencer out there REMEMBER if you are blessed GOD gave you that blessing not just for YOU but also TO HELP OTHERS GOD FIRST."

Except No Kid Hungry declared his money was no good.

The campaign's director of strategic communications Laura Washburn explained the decision in a statement to Complex. "We are grateful for Mr. Hernandez’s generous offer to donate to No Kid Hungry but we have informed his representatives that we have declined this donation," she wrote. "As a child-focused campaign, it is our policy to decline funding from donors whose activities do not align with our mission and values."

6ix9ine responded to Washburn's claim, writing on his Instagram in a since-deleted post, "@nokidhungry rather take food out the mouth of these innocent children I never seen something so cruel." His fans even flooded No Kid Hungry's Instagram pictures with "L" comments that signaled rejecting his major donation was their loss.

But since scoring an early prison release in April because of the pandemic, his racketeering and firearms charges might not be the only things on the "Gooba" rapper's track record that fails to align with No Kid Hungry's mission and values. In March 2015, the then-18-year-old rapper pleaded guilty to three felony counts for use of a 13-year-old girl in a sexual performance after an inappropriate video from October 2015 surfaced online. He later breached his plea deal when he was arrested for misdemeanor assault in March 2018 after allegedly choking a 16-year-old boy in a Houston mall earlier that year in January.

Registrant on paper sent back to jail for a year for having a Nintendo DS

OK, yes, it is possible to access the internet with a Nintendo DS. But which DS are we discussing? I have the first model 3DS and while I can surf the web, it is quite difficult to do. (Pic is of MY 3DS bought in 2011 but with most recent updates.) You need to have a hell of a lot of patience

Blackburn sex offender jailed after being caught with Nintendo DS consoles

A convicted sex offender who failed to tell police that he had two internet-capable Nintendo DS games consoles has been jailed for 12 months.

****, from Blackburn, was given a sexual harm prevention order (SHPO) in 2017 after being caught with extreme pornography involving animals...

When Hutchinson was asked about any other internet-capable devices he said 'no' but a search of his bedroom revealed another Samsung phone and two Nintendo DS consoles.

The defendant said he used the phone 'as an alarm clock' and a search of the device found adult pornography in the search history.

When asked again if he had any other devices he initially said no, but after a few seconds said: "All right. There's another downstairs in a purple box in the living room".

In his police interview, Hutchinson said the Samsung mobile phone was used by himself and his partner as an alarm clock but that it could be used for wi-fi and had a sim card inside.

He said the two Nintendo DS consoles had been checked previously but 'acknowledged he should have disclosed them'.

BEAUFORT, N.C. (WNCT) – A sex offender has been convicted in a Carteret County trial of being at a school serving as a shelter in the days after Hurricane Florence.

District Attorney Scott Thomas announced 52-year-old Jerry Lee Faircloth of Newport was convicted following a jury trial of being a sex offender unlawfully on-premises.

Faircloth was convicted in 2008 of crime against nature and sexual battery stemming from an October 2006 offense.

North Carolina law states sex offenders are barred from being on premises of any place that is primarily for the use, care, or supervision of minors, including schools, children’s museums, child care centers, nurseries, and playgrounds.

Immediately following Hurricane Florence, Carteret County Probation Officers went through the county, looking for any probationers who had been displaced by the storm.

One of the places they went to was the Newport Middle School, which was designated as one of two storm shelters in the area.

An officer recognized Faircloth, as he had supervised him on probation previously, and believed he was a sex offender.

The officer in charge of the sex offender registry confirmed that Faircloth was a sex offender, so the officers returned, with a Carteret County Sheriff’s Office deputy, and found Faircloth standing by the front entrance of the school.

The officers told him to leave, as he was in violation of the sex offender laws by being on the premises of the school.

Although the defendant claimed to have been visiting a family member who was in mental distress, the officers spoke with the family member, who showed no signs of distress in their presence.

Carteret County Deputy Sheriff Harold Pendergrass obtained a warrant charging Faircloth with Being a Sex Offender Unlawfully on Certain Premises.

The jury found Faircloth to be guilty of the charge against him.

Faircloth then pleaded guilty to the status of a habitual felon, having at least three separate felony convictions on his record.

Resident Superior Court Judge Josh Willey then sentenced Faircloth to a prison term of 84 to 113 months in prison.

The prosecution was aided greatly by an official from the Carteret County Department of Social Services, who explained in detail the records kept of people who stayed in the school, the absence of records allowing Faircloth on the premises, and the rules of the shelter operation.

Minnesota Court rejects civilly committed registrant's bid to change legal name to "Better Off Dead"

And for the New Year, lets start it off with an interesting case. 

I have been in contact with some folks at the Minnesota Civil Commitment Program (MSOP) and have hosted a blog on behalf of one person currently indefinitely detained for 10 years. Those in the MSOP ("Minnesota State's Other Prison" as it is derisively called on the inside) have tried many ways to share their experiences. This way certainly received some attention. I commend Mr. Better Off Dead for trying this unique protest.

Too bad the courts rejected this form of protest and I thumb my nose to this kangaroo court. 

Maybe I'll retire my old "Fallen One" moniker and legally change my name to Derek "F**k-The-Registry" Logue someday. 

MN COURT REJECTS CIVILLY COMMITTED SO’S NAME CHANGE TO “BETTER OFF DEAD”

A man indefinitely committed as a sexual predator can't rename himself "Better Off Dead" even when he claims he's doing it for religious reasons, the state Court of Appeals ruled Monday.

Hollis John Larson has been committed since 2008 under the MN SO Program (MSOP) that allows for indefinite confinement for predators. Larson "professes a religious belief involving Hinduism, Taoism, Buddhism, and Agnosticism," the court said. His desired name change is "in accordance with that religious belief and to express his freedom of speech."

A three-judge panel of the state Court of Appeals agreed with a lower-court ruling denying the name change in part because "Better Off Dead" is an idiomatic expression, contains no pronouns and is "inherently misleading."

Larson, who represented himself, said the only way for him to "achieve reconciliation with the divine is to escape the cycle of birth, life, death, and rebirth by being and remaining dead," according to the ruling.

The District Court didn't buy it, saying that the name Better Off Dead "has no known connection to any particular religious faith or belief."

Anoka Co. objected to the name change on the grounds that it would be confusing to law enforcement. The District Court, and now the Court of Appeals, agreed with that argument. The courts also said that denying the change wouldn't impinge on Larson's constitutional rights. Larson failed to convince the court that he did not intend to "defraud or mislead," the ruling said.

The inmate stated that every document "created by his current captors" with his new name Better Off Dead would also refer to his old name and wouldn't cause confusion or harm public safety. Anoka Co. countered that the name change would compromise the public's ability to maintain and access his records.

The Court of Appeals also rejected the name change on freedom of speech grounds. Larson claimed that renaming himself Better Off Dead was a "peaceful form of protest against [the government], all these entities that caused me this pain and suffering and leading to my philosophy in life." He argued that the name change would allow him to "officially communicate his life philosophy to society," the ruling said.
