Sex offender removed from the hospital during the birth of his child
Updated: Nov 21, 2019 - 11:48 PM
PITTSBURGH - Many of the stories we bring you on a daily basis here at WPXI are clear cut. They're right or wrong. But this one had us here in the newsroom debating and even questioning ourselves. It's one of those rare instances where you see both sides.
Ken Moore is a registered sex offender but never thought that would keep him from seeing the birth of his third child.
"I did what I did," said Ken Moore. "I understand that was wrong and it's something I have to live with. I was there for my other two and this one, I got to see pictures and that was about it."
Moore pleaded guilty to possession of child pornography in 2017, served 49 days in jail and was released on probation. He must register as a sex offender for 25 years, and he's not allowed to have unsupervised visits with his children.
Moore admits he did something wrong by downloading images and movies, but he says he's now getting counseling and therapy and he says he's never harmed anyone.
Moore lives apart from his wife and children now, but in October he went to Mageee Women's Hospital with his wife for the birth of their third child. After he got his wife set up in her room, he went to tell security about his conviction. His counselor and probation officer told him he should alert security as a precaution.
"As soon as I told that guy his eyes got big and everybody started walking around and an officer came up beside me and he told me I'm sorry," said Moore. "I'm glad that you came up and came forth with that, but we're going to have to have you escorted out of the building."
"Did he give you a reason why?" asked reporter Rick Earle.
"I asked and he said, 'Because you're on Megan's Law. It's against our policy for you to be here,'" said Moore.
Moore said he was escorted off the property and wasn't even allowed to retrieve his belongings from his wife's room. He eventually got a ride home from Oakland and missed the birth of his son. UPMC told Target 11 that patient care and safety is their highest priority.
UPMC officials sent us this statement:
"We understand the sensitivity involved when the father of the baby is found to be on the registered sex offender list. Under those circumstances, it is within the discretion of the hospital administration and security whether to permit him to visit the baby and/or his partner/wife. These decisions are made on a case-by-case basis."
Magee would not elaborate on the decision to remove Moore before the birth of his child.
Moore says security offered to escort him to the room the next day, but he declined fearing that he might be arrested. He finally got to see his son when his wife returned home.

Granville NY area church cancels Registered Person's wedding following threats of protests
I understand that some folks get scared when there are online threats, but I've dealt with vigilant trolls for years, and all Internet gangsters are chickens in real life. And Christ stood up for what was right, even at the cost of followers and ultimately his life. That's why I feel the church was wrong to kowtow to the people threatening to protest. I feel like a great opportunity to teach about the boldness of Christ was lost by chickening out.
Protest my wedding and I'll come out and take selfies with you.

BLOG: Church pulls plug on sex offender's wedding

Many people who followed David Saladin's child sex abuse case for molesting children at a daycare center where he worked believe he should be in state prison.
Instead, because the Warren County District Attorney's Office had concerns about evidence in his case and having two young children testify at a trial, Saladin was offered a plea deal that includes 10 years on probation.
(Saladin pleaded guilty to all of the charges against him, with an understanding that he would not be sentenced to jail.)
That sentence did not sit well with many who followed the case, understandably so. But when word got out on social media in recent days that Saladin was planning to get married days after his sentencing, and the invitation that was posted on Facebook talked of the "fairytale" relationship, the you-know-what hit the proverbial fan.
The wedding was to be held Saturday at South Granville Congregational Church.
Pastor Rick Backus said that he was aware Saladin had been accused of child sexual abuse after the wedding was booked, but in light of the fact he hadn't been convicted the wedding was going to be allowed. But after he was sentenced last week, Backus said it was decided the church would not allow the ceremony under the circumstances.
Many reached out to the church through Facebook on Monday and Tuesday to express their concerns about the wedding, before learning the church had pulled the plug. Some talked about going to the church to protest during the wedding.
"My phone was going off like crazy," Backus said. "I got about two hours of sleep last night."

Kansas City media freaks out over registered person's lawn art
I can't imagine this "lawn art" is all that attractive but leave it to the new media and a few nosy Nellies to make the jump from art being tacky to art being a lure for kids.

SEX OFFENDER'S ART SCULPTURE ALLEGEDLY ATTRACTS CHILDREN, DISRUPTS NEIGHBORHOOD
BY MARIKA MALAEA ON 10/8/19 AT 6:16 PM EDT
An art sculpture in the front yard of a Kansas City home attracts a lot of children, which has the surrounding neighbors upset. Normally such art wouldn't be a problem, though in this case, it's in the yard of a registered sex offender.
The sculpture is made of hanging bikes, and a majority of the bikes look like they're for kids. The neighbors thought it was a piece of art until they found out the creator and man who lives there is a registered sex offender in Missouri.
"They got my attention with these bikes up here. They got put up here. I thought it was art, and it was nice. But if it got my attention, it'll get another child's attention," a woman who visits family in the neighborhood told WDAF.
The man's name is Fidel Nunezreyes. He was most recently convicted of statutory rape in 2004. His victim was an underage female.
Neighbors said he has lived in this neighborhood for about three years. Other residents said they wish Nunezreyes would have told them his status.
Missouri laws require sex offenders to register within three days of following a conviction or release from jail or prison. The Missouri Sex Offender Registry lists June 2005 as Nunezreyes' confinement release date.
Registration as a sex offender is required for anyone who has pled guilty to or been convicted of a number of crimes, including rape, child molestation, sexual misconduct, kidnapping a child, sexual exploitation of a minor, possession of child pornography, sexual abuse of a child and many more.
Those who plead guilty or no contest to these crimes are also required to register as sex offenders.
Many sex offenders are not allowed within 500 feet of school grounds, and while there are a handful of schools in the area—including two elementary schools, two middle schools, a charter school, a performing arts high school and an early education center—they fall outside of the 500-foot range from Nunezreyes' home.
Neighbors are concerned that the hanging bike art sculpture will continue to attract kids to his home, leaving the children vulnerable to someone has proven to be untrustworthy with a child in the past.
"I feel like the children aren't safe around here. I don't feel like the kids are safe because he still never said nothing," one neighborhood woman said.
People who frequent the area said along with the sculpture, Nunezreyes needs to leave the neighborhood.
According to Family Watchdog, a free service that allows you to view known registered offenders and predators in your area, there are 1,511 known and mapped offenders in Kansas City, Missouri.

Not only does the New Orleans Police Department have a "Pedophile Unit", the former chief of that unit is an actual pedophile
Oh look, "Nawlins" finally gave us someone nuttier than ex-mayor Nagan.
I don't know what's worse, the NO police having a "pedophile unit" or having one of said unit's detectives busted for molesting a kid & downloading CP

Richard Windmann files lawsuit against former head of NOPD’s pedophile unit, the City of New Orleans
By Kimberly Curth | September 4, 2019 at 4:39 PM CDT - Updated September 4 at 10:55 PM
NEW ORLEANS, La. (WVUE) - The former head of the NOPD’s pedophile unit and the City of New Orleans are now at the center of a lawsuit.
Richard Windmann filed the lawsuit Wednesday (Sept. 4) in Civil District Court. Windmann claims Stanley Burkhardt repeatedly sexually abused him while Burkhardt was a sex crimes detective. FOX 8 has done extensive reporting on Burkhardt and interviewed two men, including Windmann, who say the former cop sexually abused them decades ago.
In the lawsuit, Windmann said the City of New Orleans failed to protect him from Burkhardt. He also claimed he was first introduced to Burkhardt in 1977 when he was just 12 years old. During that time, Windmann testified against an assistant Boy Scout Master who was convicted of sex abuse against boys.
Burkhardt, an NOPD detective at the time, was supposed to look out for Windmann. But, Windmann said one night Burkhardt took him to the NOPD’s evidence room, showed him child pornography then sexually abused him. Windmann alleges the abuse continued for the next few years.
Then, the suit claims Burkhardt started taking Windmann to pedophile parties in the French Quarter and would use him as bait to make cases against other pedophiles. When Windmann started to push back against Burkhardt, he said Burkhardt showed him a picture of a badly decomposed body of a boy who was later identified as Eddie Wells.
According to Windmann, Burkhardt would threaten him with that picture, saying that if he refused to do what Burkhardt told him to do, he would end up like Eddie Dirt.
In the lawsuit, Windmann said he tried to report Burkhardt’s abuse to the NOPD twice, but detectives did not take the report and he was shunned.
Burkhardt has been convicted of child molestation and child pornography. Last month, State Troopers arrested Burkhardt for failing to register as a sex offender. He is now in Federal custody in North Carolina.
FOX 8 reached out to the City this afternoon about the lawsuit, but a spokesperson said they “have no comment at this time.”
Legal analyst Bobby Hjortsberg says while the statute of limitations will come into question, Burkhardt's convictions are already a good argument.
“They’re likely going to say look not only was this individual negligent for his actions, but the people who were supervising him were negligent in not identifying this,” Hjortsberg said.

Registrants arrested in Tennessee for the crime of having lunch at McDonald's
Yes, in certain states, registrants cannot even eat at a McDonald's if it has a playground area.
McDonald's sucks anyways.

Sex offenders say they were 'just having lunch' prior to arrest near Memphis McDonald's playground
Updated: Aug 19, 2019 - 8:01 PM
MEMPHIS, Tenn. - Two violent registered sex offenders were arrested Saturday near a Memphis McDonald's.
According to a police report, around 4 p.m. Saturday a manager at the McDonald's located in the 3300 block of Austin Peay Highway called the police.
The manager said she believed a registered sex offender was sitting next to the indoor playground at McDonald's staring at children who were playing.

She told officers the registered sex offender, Robert Lee Collier, was caught on camera the previous day inside the playground area.
When officers arrived at the McDonald's, Collier and another known sex offender, Morris Johnson, were both sitting next to the indoor playground where approximately three children were actively playing.
Collier and Johnson were arrested for being within 1,000 feet of a playground where children were present. Both men were transported to the Felony Response Bureau.
Collier, however, told FOX13 he was “just having lunch with a friend” when the police were called.
“I did not consider that to be an area that I wasn’t supposed to be in, it being a public restaurant,” said Collier.
After his court appearance Monday, Collier told FOX13 he was not staring at the children as they played, but rather he was staring at the food he was eating.
This isn't the first time Collier has been arrested. Back in May of 2018, he was arrested for exposing himself to an 11-year-old child at the Wolfchase Galleria.
Police told FOX13 the child was trying to leave the bathroom when Collier allegedly grabbed his arm and neck. Officers said he pulled down his pants and exposed himself to the victim.
MPD said his mother heard him and responded.
According to the Tennessee Sexual Offender registry, Collier was placed on the registry for criminal attempt to commit aggravated sexual battery on May 19, 2018.
Morris Johnson was also placed on the registry for criminal attempt to commit aggravated sexual battery on February 15, 2003.
Both suspects have bonded out of jail with a $3,000 bond.
Collier said he was falsely accused in 2018, and he is being falsely accused again now.
“I clearly don’t have a problem. I’ve been falsely accused of this situation. I’m fighting this to the end: not guilty,” he said. “There’s no proof of this, I just want justice.”
According to Collier, Johnson has been his best friend for seven years. Johnson was placed on the sex offender registry for criminal attempt to commit aggravated sexual battery in 2003.
FOX13 reached out to the judge working on the case to ask how Collier – a violent registered sex offender – could have been booked into jail while on probation and released on a $3,000 bond.
The judge has not yet responded.
Kris Crim, the prevention director at the Memphis Childhood Advocacy Center told FOX13 about how to protect your children from sexual abuse in public places.
“The best way for parents to protect their children from sexual abuse is to be armed with knowledge. The Stewards of Children training offered by the Memphis Child Advocacy Center teaches adults how to prevent, recognize, and react responsibly to child sexual abuse.
Parents learn how to recognize red flag behavior, deter predators, and talk with their kids about sexual boundaries. Over 24,000 Shelby County adults have been trained since 2011.”
Anyone interested in taking the class can learn more here.
The advocacy center also provided these tips on how to minimize the risk of children being sexually abused. They include understanding grooming behavior by predators, talking to your children, monitoring your child’s internet use, and understanding what to expect of your child’s sexual development.

For a moment, Facebook Standards allowed death threats against those accused or convicted of sex offenses
For a moment, Facebook formally acknowledged a policy they have followed informally for years. They have allowed vigilante groups targeting registered persons to operate on FB and harass and threaten them in violation of a number of state laws, like No Peace For Predators or Truckers Against Pedophiles. Even law enforcement agencies have used Facebook pages to harass registrants.
Of course, Facebook backpedalled not long after the story broke. So now they will just go back to ignoring the reports of death threats against registered persons informally as they have done already.

Facebook updates standards to allow death threats against alleged sexual offenders
by John Gage
| July 09, 2019 09:35 PM
| Updated Jul 10, 2019, 04:07 PM
Facebook updated its community standards to allow for users to call for "high-severity violence" against sexual offenders, including death threats.
In its " Do not post" section on its website, Facebook changed its standards in a July update to allow an exception to its "Violence and Incitement" standard for individuals "described as having carried out violent crimes or sexual offenses, wherein criminal/predator status has been established by media reports, market knowledge of news event, etc."
The exception allows users to make: "Threats that could lead to death" against alleged violent and sexual offenders. Facebook does not require for the threats to be against persons who have been convicted under criminal law.
Facebook did not return the Washington Examiner's request for comment at the time of publication. In May, the company said: “We’ve always banned individuals or organizations that promote or engage in violence and hate, regardless of ideology."
"The process for evaluating potential violators is extensive, and it is what led us to our decision to remove these accounts," the Facebook spokesperson added.
The standards change by Facebook comes as federal prosecutors charge financier Jeffrey Epstein with sex trafficking and conspiracy.
Southern District of New York prosecutors said Epstein “enticed and recruited, and caused to be enticed and recruited, minor girls" as young as 14 in order to "engage in sex acts with him."
UPDATE:
"We don’t allow credible threats of violence against anyone. We do allow some speech that calls for certain forms of violence, such as calls for the death penalty for criminals or support for military action against terrorists. We have updated our Community Standards to be more clear about this," Facebook spokesperson said in a statement to the Washington Examiner.
Facebook updated their community standards again saying the language they added earlier in July was "imprecise."
"The language we previously used to describe our policies against violence and incitement was imprecise. We have since replaced it to more clearly explain the policy and underlying rationale," the Facebook said in an update to their "Violence and Incitement" community standards.
"In some cases, we see aspirational or conditional threats directed at terrorists and other violent actors (e.g. Terrorists deserve to be killed), and we deem those non credible absent specific evidence to the contrary," the company said.

Tag reading cams going up at these schools to catch speeders, sex offenders

GWINNETT COUNTY, Ga. - School's out, but new safety measures are already planned for the upcoming school year.
New tag reading cameras are going up at four schools in Gwinnett County to catch speeders and sex offenders in school zones.
“I believe it’ll be a great idea because the safety of our children is what’s important," said parent Lauren Walker-Robertson.
Over the next few weeks, crews will install cameras at four Duluth schools: Mason and Chattahoochee elementary schools, and Duluth and Coleman middle schools.
The cameras will record any driver who speeds through the school zone.
“Take an 8-second video of each vehicle that is speeding and the tag of that vehicle," Duluth Police Department Officer Ted Sadowsk said.
Officials are also working to allow the cameras access to the statewide offender database. That way, the cameras can read tags and alert police of sex offenders who enter school zones.
“So, it’s not just speed cameras, it’s two-fold. It also acts as a safety measure for the schools as well," Sadowski said.

Illinois just wasted $2 million dollars on prosecuting masturbating inmates
I don't think a picture is necessary today...

$2M Legal Fees In Cases of Masturbating IL Inmates
By Crime and Justice News | June 5, 2019
Legal fees for cases relating to masturbating detainees at Cook County Jail could reach more than $2 million, reports the Chicago Sun-Times. The county board’s Finance Committee on Wednesday will consider the latest $486,216 in fees and expenses for five cases brought by public defenders, sheriff’s officers and other female county employees exposed to harassment. That is on top of nearly $1.7 million the board already paid out. It’s been dubbed an “extreme brand of workplace sexual harassment” by one state senator, who sought increased penalties for the lewd behavior.
The problem got so bad a federal judge in 2017 ordered all Cook County jail detainees with a history of indecent exposure, masturbation or sexual misconduct to remain handcuffed “at all times” during courthouse visits. Six employees of the Cook County Public Defender’s office filed a sexual harassment suit, saying the problem dated back to 2015. They described frequent encounters with detainees who would masturbate, sexually harass or expose themselves to lawyers during meetings. Dozens of female sheriff’s officers filed suit against Sheriff Tom Dart in 2017 and last year, alleging that he hadn’t done enough to protect them from near daily encounters with detainees who would sexually harass and assault them. The fees before the committee on Wednesday relate to five cases brought by public defenders, jail guards, a court interpreter and a nurse. Cara Smith, Dart’s chief of policy, said the cases have not been settled.

Boy Scouts of America wants to bypass the concept of innocent until proven guilty by creating a registry for those merely accused of a sex crime
Let's just bypass this whole criminal justice thing and make a registry for someone merely suspected of committing a crime. What could possibly go wrong, huh?

BOY SCOUTS OF AMERICA WANTS A SUSPECTED SEX OFFENDER REGISTRY FOR ‘YOUTH SERVING’ ORGANIZATIONS TO SHARE

The Boy Scouts of America (BSA) proposed creating a suspected sex offender registry in a statement Tuesday in efforts to control backlash over sex abuse within the organization.
BSA responded to Tuesday allegations from lawyers that 200 Boy Scout leaders sexually abused minors. The law firms of Greg Gianforcaro and Jeff Anderson & Associates revealed the Boy Scouts’ infamous “perversion files” mentioned the accused leaders. These files contained allegations of sexual abuse that the Boy Scouts of America kept secret.
The organization suggested creating a national registry for suspected sex offenders as a way of combating sexual abuse within youth organizations. (RELATED: Law Firms Asking Boy Scouts To Name 200 Leaders Accused Of Sexual Abuse)
“We fully support and advocate for the creation of a national registry overseen by a governmental entity, similar to the national sex offender registry, of those who are suspected of child abuse or inappropriate behavior with a child, and thus allowing all youth-serving organizations to share and access such information,” Boy Scouts of America said in a statement provided to The Daily Caller News Foundation.
“We are eager to share the information contained in our database with other youth serving organizations,” said Erin Eisner, Chief Strategy Officer for the Boy Scouts of America in prepared remarks provided to TheDCNF.
“Our vision, and one shared by others working hard in this space to protect youth, is that all youth serving organizations would be required to track and document those adults who have harmed children or have been suspected of harming children and report this information into a national registry.”
Eisner said that this registry would be similar to the Department of Justice’s National Sex Offender Public Website in that their mutual goal is “the creation of a registry for those who seek to work with children.”
“This would reduce the risk that potential abusers could gain access to children by moving or going to another youth-serving organization after being removed,” Eisner said. “We are working with other groups and organizations such as the National Center for Missing and Exploited Children and the CDC to see how we can assist in this critical development. We’ve also called on Congress to partner in these efforts and to develop legislative mechanisms to facilitate this national database into a reality.”
The statement also claims that the Boy Scouts of America have never knowingly employed anyone accused of sexual abuse. However, Anderson argues that this is not the case.
“All the pledges and promises from the Boy Scouts of America fall short,” Anderson said in a statement provided to The Daily Caller News Foundation. “The reality is, they have to identify the names of thousands of offenders from their secret files. The Boy Scouts need to come clean and inform the communities who these people are, what they did, and where they are today.”
Anderson insists that failure to release the names of the thousands of accused indicates that The Boy Scouts of America fall short in protecting children. “Through a simple keystroke, they have the ability today to release the names and locations of every offender that sexually abused children. Absent that, any effort, promise, pledge, practice is falling short of protecting kids. This is a time for action and truth, not a time for excuses, promises or policies.”

How recognising Jesus as a victim of sexual abuse might help shift Catholic culture
There are good theological grounds for recognising a connection between Christ and those who have been subjected to abuse
David Tombs
The crisis of sexual abuse within the Catholic Church, and the institutional denial and cover up, has left many people of faith shocked by the lack of appropriate response towards survivors.
Archbishop Mark Coleridge of Brisbane, the president of the Australian bishops’ conference, has called for a Copernican revolution on sexual abuse in the church and a shift in Catholic culture so that abuse survivors, not clergy, shape the church response.
In an interview with Crux, published during the recent Vatican summit on sexual abuse, he also compared victims of clergy abuse to Christ crucified. "Unless you see what's happened to the abused has happened to Christ and that therefore, they're Christ crucified in their needs, all the external command sin the world won't do it."
In our work, Rocio Figueroa Alvear and I have interviewed sexual abuse survivors and show that recognising Jesus as an abuse victim can help them, and help the church to change.
There are good theological grounds for recognising a connection between Christ and those who have been subjected to abuse. The words of Jesus in Matthew 25:31-46 say that what is done to others is also done to Christ, and this has been explored in the work of Beth Crisp.
In Matthew 25, and presumably in the words of Archbishop Coleridge, this connection is at a theological or metaphorical level. But recent work has offered a strong argument to go beyond the theological connection and to see a more literal historical connection. In my own work, and writings by Elaine Heath, Rev Wil Gafney and Australian theologian Rev Michael Trainor, it is argued that Jesus does not just share theologically in the abuse, but that he himself experienced sexual abuse during the crucifixion.
This may seem outlandish at first. When Katie Edwards and I wrote on stripping as sexual abuse, many comments showed readers were perplexed that we could be seriously suggesting this. For many people, the initial reaction is to be startled and shocked. Some ask whether it is meant to be a serious suggestion, or say it is just jumping on a #MeToo bandwagon. However, as Linda Woodhead points out, if you look at it more closely you may start to think differently.
The torture practices of military regimes in Latin America during the 1970s and 1980s offer two key lessons for understanding crucifixion. First, the torture was a way for the military authorities to send a message to a much wider audience. Anyone who opposed the military would know what to expect.
Second, sexual violence was extremely common in torture practices. Sexual violence was a very powerful way to physically and psychologically attack a victim and his or her dignity. Sexual humiliation and shaming victims could destroy their sense of self and stigmatise them in the eyes of others.
The use of crucifixion by the Romans fits with both of these. Crucifixion was a form of state terror which threatened and intimidated many more people than the victims themselves. The way that prisoners were stripped and crucified naked was an obvious way to humiliate and degrade them, and should be recognised as a form of sexual abuse.
In research published this month, we interviewed a small group of Peruvian middle-aged male survivors of clergy abuse on how they respond to the historical argument that Jesus was a victim of sexual abuse. We had interviewed this group before on how the sexual abuse they had experienced when they were teenagers and young men had impacted on their lives.
In these new interviews, we asked if they had considered Jesus as a victim of sexual abuse and how they viewed the historical and biblical evidence for it. We also asked if any such recognition could be helpful for them and other abuse survivors, or the wider church.
Most interviewees were initially surprised by the idea, but saw no problem in accepting the historical evidence and argument. Only one participant initially said that not enough evidence was presented to show it was sexual abuse but he later explained that he saw Jesus’ nakedness as a form of complete powerlessness.
Participants were evenly split on the question whether it would help them. About half felt it would not but the other half spoke positively of the connection it created between Jesus and survivors.
On the significance for the wider church, all of the participants agreed, without hesitation, that it would have a positive impact. All of them suggested that church ministries, clergy and lay, should embrace this topic.
They felt it would help the church to achieve more solidarity with survivors, and also, a more realistic and historic vision of Jesus. If the wider Church embraced this history and deepened it theologically, it might help towards changes in the church which prioritise survivors, and ensure they are treated with more compassion and solidarity. If the church is seeking a Copernican revolution on sexual abuse, recognising the experience of Jesus for what it was is surely an appropriate starting place.

Add milk truck driver to jobs a registered person can't do, at least in Iowa
I am admittedly on the fence about this one. I personally wouldn't take any job that makes people think I'm out trying to have contact with kids for this very reason, but honestly, when would a person making a delivery to a back dock of a building have contact with anyone inside a school? The amount of coverage this article gives to this story is astounding.

Sex offender stops school milk deliveries
Mark Mahoney mmahoney@nwestiowa.com Apr 8, 2019 Updated Apr 8, 2019
REGIONAL—A registered sex offender is no longer delivering milk to three N’West Iowa schools.
Up until about March 20, Christopher James Driesen of Inwood had been delivering milk since last fall to the George-Little Rock and Rock Valley school districts and to Western Christian High School in Hull.
The 35-year-old Driesen had been delivering milk to the schools for Rock Valley-based Scott’s Dairy, which is owned by his father, Scott Driesen.
However, what the younger Driesen was doing is illegal, said special agent Scott Lamp of the Iowa Division of Criminal Investigation’s Iowa Sex Offender Registry Unit.
By delivering milk to schools, Driesen — who had to register as a sex offender in Iowa for felony sex-abuse crimes against juvenile females he was convicted of 11 years ago in Sioux County — violated Iowa Code Section 692A.113.
Lamp described Iowa Code Section 692A.113 as “the exclusion zones law under the sex offender code.”
According to one part of Iowa Code Section 692A.113, a sex offender who has been convicted of a sex crime against a minor shall not “operate, manage, be employed by, or act as a contractor or volunteer at a public or nonpublic elementary or secondary school, child-care facility or public library.”
‘You can’t do that’
“In no certain terms, he cannot be an employee or a subcontracted employee at any time on school property, regulated day-care property or library property,” Lamp said of Driesen. “He can’t loiter within 300 feet of those properties.”
Lamp said a school district superintendent or a school’s head administrator may give written permission for a registered sex offender like Driesen to attend school activities, but not for employment on school grounds.
“A superintendent can write a letter for somebody that is a sex offender with a minor victim who wants to attend, let’s say, a Friday night football game,” Lamp said.
“Presence upon school property is for school activities,” he said. “Presence upon school property does not apply to employment.”
Lamp again referred to Iowa Code Section 692A.113, specifically pointing out that employment includes volunteering, according to state law.
“Volunteering means employment in the Code,” Lamp said.
In March, Lamp’s office in Sioux City received complaints through the Iowa Sex Offender Registry website about Driesen delivering milk to N’West Iowa schools.
“I had sent an e-mail out to a couple of different schools,” Lamp said. “I basically told these superintendents that if they know anybody that has these types of agreements, it’s done.”
He re-emphasized that a school district superintendent or a school’s head administrator cannot authorize employment authorization to a registered sex offender who has sexually abused a minor victim.
“If you have those agreements for presence upon school property for the delivery of milk, you can’t do that because the superintendent doesn’t have the authority when it comes to employment,” Lamp said.
“If you have those agreements on file, they need to be rescinded immediately,” he said. “You should do it in writing.”
‘Clarified expectations’
George-Little Rock superintendent John Eyerly confirmed that Driesen had delivered milk to what he called “non-student areas” at the district’s elementary school building in George and combined elementary/middle school structure in Little Rock.
“It was just right into the door of that lunchroom area and to a cooler and then back out,” Eyerly said of Driesen’s milk deliveries to George-Little Rock. “Again, it was just inside the door, bring it to the cooler and then out — not in any student areas.”
Eyerly spoke with Lamp for the first time on Wednesday, April 3, about Driesen delivering milk to George-Little Rock school buildings.
“He clarified expectations for schools,” Eyerly said. “He sent me the statute. The agent clarified the information about the statute and the expectations for schools.”
Lamp had sent an e-mail to George-Little Rock nearly three weeks ago about the Driesen situation, but Eyerly said he never received it until Lamp sent it again on Wednesday, April 3.
“He had sent it to other schools on March 19, but I didn’t get anything — and he didn’t send it to me,” Eyerly said, noting that Lamp’s e-mail had been sent to some sort of generic George-Little Rock e-mail address. “It never came to me.”
“He clarified some things back on March 19,” Eyerly said. “I wasn’t in the office on March 19, but when I got back on the 20th, I didn’t see anything like that.”
After his conversation with Lamp, Eyerly rescinded the written permission Driesen previously had been given for being on school grounds while delivering milk.
“I want to stress that at no times were there any safety issues for students,” Eyerly said.
‘In place of his dad’
From what interim Western Christian principal Harlan De Vries could recall, Driesen’s father, Scott, had a stroke last fall and was unable to deliver milk to the N’West Iowa schools that Scott’s Dairy serves.
“Chris came around shortly after that occurred and informed me that he was listed with the sex abuse registry in the state of Iowa, but wanted to know if I would allow him on the grounds to deliver milk to the school in place of his dad,” De Vries said. “We were trying to be helpful to the family.”
De Vries granted Driesen written permission in mid-October and Driesen started arriving between 5:30 and 6:30 a.m. to Western Christian’s kitchen area on the couple of days a week he delivered milk for the school’s lunch program.
“There’s never a student on campus at that time,” De Vries said. “The head cook, for example, has mentioned he oftentimes — if not always — had another adult with him, so that was somewhat reassuring to me, too.”
Driesen’s milk deliveries to Western Christian stopped as of March 20, when De Vries received an e-mail from Lamp that said what Driesen was doing was not allowed by Iowa Code Section 692A.113.
“That came as a surprise to me because I was not aware of that at all,” De Vries said. “Once I received notice of that, I issued a letter to the Driesens — to his parents — informing them that I had to renege on the letter that I had sent to them earlier and that he was no longer allowed on our premises.”
He confirmed that Western Christian will continue to receive milk from Scott’s Dairy through the end of the 2018-19 academic year.
“We’re contracted with them for the year,” De Vries said.
When asked to comment for the story, Rock Valley superintendent Chad Janzen responded in an e-mail:
“I don’t have any comment other than that we have followed all the directives of local law enforcement. When this issue was brought to our attention, we followed the directives of law enforcement.”
‘It needs to stop’
When reached by phone Thursday evening, April 4, Judith Driesen, Scott Driesen’s wife, confirmed that her husband had a stroke in October.
She said he has not been delivering milk since then.
Scott’s Dairy delivers milk to 17 schools in the northwest corner of Iowa.
When asked about their son Christopher Driesen helping out with milk deliveries to N’West Iowa schools, Judith Driesen said, “You know what? I’m not even going there, OK?”
She hung up the phone shortly thereafter, ending the conversation.
When reached by phone Friday morning, April 5, Scott Driesen said his family did not know that his son delivering milk to the grounds of N’West Iowa schools was illegal until recently.
“It was approved by his parole officer,” Scott Driesen said. “He got approved by the Lyon County Sheriff’s Department, Sioux County Sheriff’s Department and every superintendent in every school that I deliver to.
“Chris was only going by his parole officer,” he said. “He did everything he was supposed to do.”
Sioux County Sheriff’s Office chief deputy Nate Huizenga said his department did not give Christopher Driesen special permission to deliver milk to the grounds of schools in the county.
“Not that I’m aware of,” Huizenga said. “We never gave him any permission to do that.”
The sheriff’s office was only made aware of Christopher Driesen delivering milk to N’West Iowa schools by an e-mail from Lamp in March.
“We hadn’t gotten any complaints that this was occurring,” Huizenga said.
Regarding a registered sex offender like Christopher Driesen working in Sioux County, Huizenga said, “They’re required to check in with us if they’re working in our county.
“They have to know what their rights are,” Huizenga said. “They have to know what they can or can’t do. If they violate those, they can be charged.”
Lamp confirmed he spoke with Christopher Driesen on March 19 about him delivering milk to N’West Iowa schools.
“He personally knows who I am,” Lamp said. “He knows my status as a law enforcement officer assigned to the DCI, especially the sex offender registry unit.
“With that in mind, I had a conversation with him,” he said. “I said, ‘We’re hearing complaints. If that’s the case, it needs to stop — immediately.’”
Lamp could have arrested Driesen — a full-time construction worker, according to Lamp — on a charge of failure to register as a sex offender.
“It’s called an exclusion zone violation under 692A.113,” Lamp said. “It’s an aggravated misdemeanor for a first offense and a Class D felony for a second offense. It’s based upon the registrant’s criminal history.”
Lamp has been part of the Iowa DCI’s Iowa Sex Offender Registry Unit since August 2007. His territory covers 22 counties in the northwest part of the state.
He could not recall dealing with a similar situation like the Driesen one. Lamp has been in Iowa state law enforcement since 1994.
“It’s pretty explicit what the Code says,” Lamp said, though he conceded that Iowa Code Section 692A.113 “is not an easy read.
“It’s just like any other portion of the Iowa Code — if you want to read it, you might have to read it two times,” he said. “There may be some miscommunication on what a superintendent is allowed to do.”
