INDIANAPOLIS — There are more than 1,800 sexual or violent offenders living in Marion County, more than half of which were convicted and sentenced from out-of-area, according to the Marion County Sheriff's Office.

As part of the office's efforts to drive down the number of sex offenders in the community, the sheriff's office conducted a sweep Wednesday morning near Brookside Park.

The Sheriff's Office says 34 registered sex offenders live within a half mile of there.

"That is a ridiculous number to be in that neighborhood," said Sheriff Kerry Forestal.

Two suspected sex offenders were arrested during the sweep which took place in the neighborhood on the city's Near Eastside.

"The sweep was necessitated by the fact that thirty-four sexual or violent offenders reside within a half-mile radius of Brookside Park, sixteen of whom were convicted outside of Marion County," the Sheriff's Office said in a news release provided after the sweep was completed.

Marion County Sheriff's Capt. Mitch Gore told WRTV that the sweep was pre-planned and took several hours to complete. The sweep was given the name "Operation Watchful Eye."

The operation was conducted close to where a woman was fatally shot early Wednesday — but that investigation was handled by the Indianapolis Metropolitan Police Department and was unrelated to the sheriff's office's sweep.

More than 40 members of the sheriff's office, including its sexual and violent offender registry, K-9, warrant, intelligence and criminal investigations units; reserve division; and executive staff.

The two people arrested included one who was wanted on a warrant of juvenile rape and molestation charges and another who was arrested on suspicion of failing to register as a sex offender.

In addition to the arrests, the sheriff's office completed 34 compliance checks. Of those checks, 20 people were verified to be compliant with registration requirements and three are suspected to be non-compliant.

The sheriff's office also attempted to serve five warrants for sexual offenses.

There are currently 1,825 sexual or violent offenders living in Marion County, 52% of which were convicted and sentenced from another state or another county, according to the Sheriff's Office. That figure is up from 42% a year ago.

"We had two people here from Idaho. Why did somebody from Idaho decide to relocate and come here. Put our wives, daughters, grandchildren in danger," Forestal said.

"The MCSO has been successful in driving down the number of sex offenders in our community, but they are being backfilled by those sentenced from out-of-county. One of our goals remains to figure out why," the sheriff's office said in its release.

Sheriff Forestal said he believes part of the reason is because of the number of residents in Marion County.

"It's easier to hide here. If you live in Tipton they're going to know you. If you come and mix among 900,000 to one million people you may not," Forestal said.

He also says he believes there are too many programs conveniently located by the State government within Marion County saying they can use the bus lines.

"Hoosier hospitality is important, but not at the expense of the safety of Marion County residents,” Marion County Sheriff Kerry Forestal said in a written statement. “Operation Watchful Eye should serve as reminder to the public that they must be vigilant about who is in their neighborhood. But it should also serve as a warning to Marion County’s sex offender population: We are watching like a hawk and if you are not compliant, you will be found and arrested.”

Sheriff Forestal spoke candidly with WRTV about operation "Watchful Eye."

"I am not really there for their convince, they need to go back there and serve their county or their state," Forestal said.

When asked what Forestal would say to sex offenders he said, "We do not want you here."

The Sheriff says they will continue to follow up on this, adding they will be in Pike Township next week.

"If some of the people, especially the sex offenders, we will be up there. If you're not following the law go ahead and leave. We are giving you a weeks head start. Move out go back to wherever you came from. We should only be responsible for the people who committed crimes in Marion County."

Community raises concerns on operator of new business

LOOGOOTEE – The fact that a convicted sex offender has opened a tattoo shop near a preschool brought out an overflow crowd of more than 30 to Tuesday’s Loogootee City Council meeting.

Makenzie Wagoner, 19, made an impassioned plea for city officials and the public at large to take action to protect young children. She does not want the business closed, but rather forced to relocate some place away from children.

Indiana law prohibits sex offenders of minors from living within 1,000 feet of any school property, public parks and certain program centers. However, individual counties may impose other restrictions around movement, employment and alcohol consumption.

Wagoner pointed out that Indiana, unlike Illinois and a few other states, does not restrict a business owned by a convicted sex offender from being located near a school. She would like to see Indiana’s law changed.

Mayor Noel Harty said he would try to arrange a meeting in Loogootee soon between Wagoner and two local state officials, State Sen. Eric Bassler of Washington and State Rep. Shane Lindauer of Jasper.

Wagoner provided documents to the Times Herald which showed that Charles A. Taylor had been registered as a sexually violent predator in Illinois on Jan. 20, 2010. He was convicted March 8, 2005, of predatory criminal sexual assault. He was sentenced to six years in the Illinois Department of Corrections.

Taylor now lives in Loogootee. A document provided by Wagoner states the Indiana equivalent for the Illinois charge is child molesting, a felony.

Wagoner works as the youth librarian at the Loogootee Public Library. She is currently a student at the University of Southern Indiana, pursuing a double-major in early childhood education and elementary education.

“I’m fighting for this, but I should not be fighting alone,” Wagoner said. “He is going to offend again, it is only a matter of time.”

Wagoner criticized Harty for attending a ribbon-cutting ceremony last month for Taylor’s shop. She also said neither the mayor nor police chief Jim Floyd had notified the owners of the preschool nor Loogootee school officials about Taylor.

Harty said he had not found out about Tayor’s legal status as a convicted sex offender until five days after the ribbon cutting.

Floyd did not comment during the meeting, but his department issued a press release. It stated: “It has come to our attention that there are concerns about a registered sex offender opening a business in Loogootee. We are aware of this happening and found no legal authority to prohibit it. We are aware of his registry status and there is no law prohibiting the operation of this business by this individual. We, as police officers, are obligated to operate within the bounds of the law as they are written.”

Later on, the press release stated: “Freedom of speech is a constitutional right. You have the right to choose who you do business with and to express your concerns; however, harassment, intimidation, threats, violence, vandalism, etc. are illegal and may result in criminal charges.”

The sex offender registry administrator is Cpl. Joshua Seymour of the Martin County Sheriff’s Department.

Wagoner gave the Times Herald a copy of comments to her allegedly made on Facebook by Taylor. He said the law allows him to work anywhere he wants, including next to a daycare. He accused her of trying to take away from his children, stepchildren and wife. Despite his conviction, he claims he has done nothing wrong.

After she spoke, Wagoner was loudly applauded by those attending the meeting.

Sheriff’s office ramps up efforts to educate, crack down on noncompliant sex offenders in Marion County

INDIANAPOLIS — The Marion County Sheriff’s Office (MCSO) shared it has reallocated resources to put an emphasis on proactively tackling the issue of non-compliant sex offenders in the community.

Right now, Marion County has 1,815 registered sex offenders that live in it, which the MCSO said is by far the most in any county in Indiana.

“Before I was the sheriff, I was the division commander and had the sex crimes unit under me and it continued to have more people from other counties come to Marion County,” said Sheriff Kerry Forestal. He told FOX59 he hoped to discourage this as he ran for Sheriff but said several contributing factors have made it difficult to control a growing number of outside offenders coming to the county.

Data provided by the MCSO reveals a growth in the percentage of registered sex offenders living in it, who were not convicted in the county, but instead moved after their release.

In 2018, the MCSO said 39% of registered sex offenders in Marion County were convicted elsewhere. That number rose to 42% by January of 2021, and in just six months, it moved to 45% by June.

“My issue isn’t the percentage increase, it’s when those increases come,” said State Representative Mitch Gore.

“It took three years to get to 42%, an increase of 3%, but it only took six months to get to 45%,” he said, “What I think we’re seeing is an exponential increase in the number of out-of-town sex offenders and I want to know, are they talking to each other? Why are they coming here? Is the state dumping sex offenders in our county?”

FOX59 reached out to the Indiana Department of Correction, who said each release of inmates is planned with the offender by members of its Re-Entry Division and Transitional Healthcare Services team.

“Each release includes an approved placement for the releasing citizen, which is determined based on a multitude of factors, including education, employment opportunities, family support, housing, transportation, resources and any restrictions or requirements put in place by the sentencing court,” a spokesperson for IDOC told FOX59.

Still, Forestal said he feels there are programs in Marion County he believes could be moved elsewhere, making it less convenient for sex offenders to move within county limits after their release.

“It’s easier to mix into to a population of 900,000 so they’ll move their post-release housing into our county,” said Forestal. “I want Hoosier hospitality to be people that we want in our community. Now, they want to go back in their community, that’s where they need to be.”

Forestal said he wants to encourage parents to keep an extra watchful eye on their children and the MCSO is working to increase its social media awareness on the community’s non-compliant sex offenders as part of this effort.

“We want our kids safe. I think parents should be able to feel they can send their kids out to the parks without having to look over their shoulders, but we’re in reality. We do need to look over the shoulders,” Forestal said.

“We feature, every Monday, a sex offender and if you notice, they’re always somebody who’s from out of town and it’s always somebody who’s failed to register,” said Gore. “We are seeing more and more that the people that come here are failing to register.”

To make his message clear that MCSO is cracking down more than ever on sex offenders that are not complying with rules, Forestal said he placed a sign in the lobby where they are required to register, which reads, “You’re welcome in Marion County as long as you follow the law.”

“The law allows you to be here and if you follow that, fine. I don’t like the programs that encourage them to come to Indianapolis,” he said. “Some of the smaller communities they may be recognized as being what they did and they’re choosing to avoid that detection by coming here.”

Last session, Gore introduced a piece of bipartisan legislation, House Bill 1556, co-authored by State Rep. Mike Speedy, which sought to allow a county’s legislative body to restrict the ability of a sex offender to move into a community, unless they were coming for legitimate reasons like employment or treatment programs.

“It did not get a hearing, but I’m hopeful when we explain this issue to other state legislators that they see the need and they allow it to move forward,” said Gore.

He said he is meeting with other state legislators and certain stakeholders to get a firm grasp on the factors surrounding the issue, and to have firm information so they can hopefully move forward and re-introduce the legislation in next session.

“It’s a problem that the state has helped create and so it’s one that we all have to get together and try to fix going forward,” said Gore. “It’s an issue in red counties and blue counties, which don’t really exist when we talk about this issue.”

Gore shared that he is glad to see Sheriff Forestal and the department taking an increased focus on proactivity when it comes to keeping an eye on the sex offenders living within county lines.

“What it really helps us do, is it gives us much better data and a much better idea of how pervasive this issue is so I can go to my colleagues at the Statehouse, give them hard data, say ‘this is how it affects my county; I can help you get the data for your county, and can we show you, is this happening in your county to the same extent.'”

Gore said Marion County is in a unique position, where it has to deal with this problem in a greater volume than any other in Indiana.

“There are other counties that don’t have to deal with this, so they’re able to allocate resources to their jail and their warrant teams and they’re able to go out and arrest, you know, violent offenders that are on the run,” he said. “We have to dedicate a great amount of time and resources to the sex offender issue, when almost half of them shouldn’t even be here.”

Gore hopes a bipartisan piece of legislation on this would keep the issue at the forefront of Marion County residents’ minds, and to know there are things they can do, and law enforcement is doing, to keep their kids safe.

Forestal said, “We keep the eyes on the people who want to keep their eyes on the children. Sex offenders have a very high recidivism rate and to make that very clear, they do it again.”

“They’re getting a second chance. The fact that they’re out on the streets and not in jail, a judge somewhere has made the decision to allow them to do that,” Forestal said.

He said all is he asking them to do is follow the rules, and because he knows some out there are not doing that, he and his department are committed to conducting unannounced sweeps and focusing resources on the issue, as needed.

MCSO said so far, year to date, they have conducted 3,600 in-person compliance checks. Additionally, the department has launched 195 criminal investigations, which is a 49% increase from the same time period in 2018.

Also up 35% from the same time period in 2018 is the number of warrant applications made due to registered sex offenders failing to comply. So far this year, the department has made 42 applications.

This year, 36 non-compliant sex offenders have been arrested in Marion County, which the MCSO said is a 140% increase from the same time period in 2018.

Current numbers show in the county jail, there are 212 people charged with some kind of sexual or sexually violent crime. The crimes range anywhere from rape to child molestation.

Sheriff Forestal said his message for registered sex offenders in the county is clear: “Another sweep will be coming and as we mentioned before we don’t tell you when, but for the sex offenders, we will be coming for you again, so follow the rules or move out.”

“Those sweeps call it to attention that we will be knocking on your door. If you tell us this is your address, it better be current and we’re gonna take action against you.”

BLOOMINGTON, Ind. -- A 62-year-old man was arrested after he confronted a sex offender he knew was in violation of his registration orders.

Jeffrey Crowder said he snapped and went after Timothy Sylvester, 45, with a pipe wrench at a bus shelter outside IU Bloomington Hospital on June 24.

Sylvester has been convicted of molesting a child and Crowder has tracked Sylvester's case for the past four years. Crowder said he knew that Sylvester was in violation of Monroe County's Sex Offender Registry. 

"I just put my truck in park, left it running and jumped out and I had a pipe wrench," Crowder said.

Crowder's menacing threats drew the attention of police, and he was arrested on a felony charge of intimidation and misdemeanor disorderly conduct. He appeared in court Friday.

"I said I'm not leaving. I'm not leaving until you arrest him. I told them 'either your arrest him or you take me to jail,'" Crowder said.

Sylvester, who is listed as homeless on the sex offender registry and is required to register weekly with the Monroe County Sheriff's Department, has not reported since May 13.

On May 20, Sylvester was listed as non-compliant, but it wasn't until more than a month later, the day of the confrontation, that an arrest warrant was issued, only to go active this past Wednesday, June 29.

Detective Shawn Karr with the Monroe County Sheriff's Department said those registered as homeless usually get some leeway. 

"What we've done in the past is if they go past their seven days, because they're homeless, we'll usually let it go another week or so to see if we can contact them or they have contact with another police agency in the area," said Detective Karr.

Bloomington police, who had no knowledge of Sylvester's pending warrant, said Crowder was given several chances to de-escalate the confrontation.

"Our officers checked all of the warrants on the victim on this case and he was not wanted at the time, so there was no action the officers could take in regards to that. That was all explained to him but it was unacceptable to (Crowder)," said Bloomington Police Department Captain Steve Kellams.

Sylvester was allowed to go free because the system wasn't up to date. 

"I realize this much now, I'm hurting my family. It wasn't worth it." said Crowder.

Crowder went to court Friday and Sylvester, free somewhere in Bloomington, remains a wanted fugitive.

"If they're going to let a pedophile run the streets and here I am trying to do the right thing, what do I have to do, call every week to make sure he's registered?" Crowder said.

Sylvester's warrant for failing to register as a sex offender has been entered into statewide and national databases. If he's stopped by police, he will be arrested.

INDIANAPOLIS (AP) -- A federal judge has upheld an Indiana law banning registered sex offenders from accessing Facebook and other social networking sites used by children. 


Judge Tanya Walton Pratt said in an order Friday that the state has a strong interest in protecting children, and that the rest of the Internet remains open to those who have been convicted. 


The American Civil Liberties Union of Indiana filed the class-action suit on behalf of a man who served three years for child exploitation, along with other sex offenders who are restricted by the ban even though they are no longer on probation. 


Federal judges have barred similar laws in Nebraska and Louisiana. 


ACLU legal director Ken Falk says he's disappointed by Pratt's ruling and is considering an appeal.
